IF YOU DO NOT AGREE WITH OUT TERMS OF SERVICE, DO NOT ACCESS OUR WEBSITE, INCLUDING ALL WEBPAGES AND DO NOT CREATE A DBDCompNet ACCOUNT.

You take cover of all and any Internet connection fees OR ANY OTHER RELATED THIRD-PARTY FEES that may incur when accessing or using the website and account.

A. MEANINGS AND EXPLANATIONS

While reading these Terms of Service ("ToS") you may encounter shortcuts or personal pronouns. With all personal pronouns ("We", "Us" and "Our") it refers to the DBDCompNet and it's operating and managing administration ("DBD Comp Academy Group"). Every shortcut used is explained once using ("") as marking the explanation. After it has been explained, you will not encounter another explanation of what that word or term used means. Do not use any web-service to define the meaning, as we may use it under a different one. These Terms are listed in chapters, represented by the letters A-Z and subchapters represented by the numbers 1-99. Also paragraphs marked with - ("hyphen") represent a sub-subchapter or a regulation.

B. INTRO

These Terms of Service together with any applicable User Agreement ("UA"), Privacy Policy (as defined below), Terms of Use and Terms and Conditions apply across all webpages of the DBDCompNet service. You agree to check the Website periodically for new information and terms that govern your use of the DBDCA ("DBD Comp Academy Group") Services. DBDCA may update and change these Terms of Service at any time. DBDCA will inform you about those changes via email and/or by posting a notice on the Website's homepage such as the dbdcompacademy Website. Unless indicated otherwise, for example by law, such changes affecting existing and new DBDCA and/or DBDCompNet Services shall be effective at your acceptance, or thirty ("30") days after posting at www.dbdcompnet.com.

C. PRIVACY & DATA COLLECTION

As the DBDCompNet is a service of the DBDCA, its Privacy Policy including these additions apply on the Website and all webpages across this domain ("Web-Adress"). (Art. 13 GDPR)

• Contact data (e.g. email adress)
• Personal data
  • Content Data: includes information about your login.
  • Other Organization Data: when applying for one of our staff positions we ask for your past tournament info.
  • Marketing Data: includes your preferences in receiving marketing from us and/or advertisements of our partners/third-parties.
  • Profile Data: includes your username and password, information you provided when contacting our support
  • Interaction Data: includes information about messages, posts and reactions.

All this data is reffered to as "Personal Data". We may collect, use and store these points. We do not collect data about any special categories ("sexual orientation", "race or ethnicity", "religious beliefs", "political or philosophical beliefs", "health information"), neither will our staff or any responsible member ask you for it.

   1.1 Failing to provide Personal Data

If you fail to provide Personal Data we are allowed to decline you services that we provide in exchange for those data points. By creating your account you open a contract with the representative of the DBD Comp Academy according to the imprint. (Art. 6 GDPR)

   2. Privacy Acknowledgement

You understand, acknowledge and agree that any public communications on DBDCA Services, including www.dbdcompnet.com are not private or confidential, and may be viewed and used by others accessing the DBDCA Services.

You understand, acknowledge and agree that you can, at any time with any reason or without, request all information that we store from you by requesting it by email to support@dbdcompnet.com

D. ACCOUNT

While some DBDCA Services may be generally accessible by public, certain aspects, such as internal webpages, specifically designed for our partners/third-parties are only accessible using a DBDCompNet Account (the Account).

Only "natural persons" may create an account, however any legal entity (e.g. corporations, limited liability companies, and/or partnerships) may not create their own account or use a natural person's account. By creating your account and entering into this Agreement, you represent that you are an adult and have the legal capacity to enter into a contract. You agree to comply with this Agreement on behalf of yourself and, at your discretion, any minor children for whom you are the parent or legal guardian and whom you have authorized to use the Website using your account. You also agree that you are liable for all activities conducted through and with your account, and are responsible for ensuring that you and/or your child is aware, understands and complies with our Terms of Service and all policies. You also understand, acknowledge and agree that you can object to your child having this account, by writing an email to support@dbdcompnet.com, we are then obligated by law, to delete and erase all personal data that we collected from your child and permanently lock their account. You also understand, acknowledge and agree that once you objected to your children's account, it can no longer be recovered. You understand, acknowledge and agree that you are not allowed to impersonate others, especially:

• Content Creators,
  • of any kind.
• Organizations, Companies etc. (all legal entities),
• Members of a Team,
• A Team directly,
• A Staff member of the DBDCA (and all sister organizations)

To create an Account, you must have an email adress, and provide accurate and truthful information. Please note that special services may require more information such as your name, full adress and in some cases government ID. These data collections can happen by legal reasons, such as report to government for organising terror etc. Some DBDCA Services ("DBDCompNet") requires for your Discord ID, we use this ID's last 4 numbers to create your specific username. You are required to protect this username creating a password for your Account.

You understand, acknowledge and agree that the DBDCA and the DBDCompNet administration have the right to block/restrict your Account for any reason, at any time. You also understand, acknowledge and agree that we are not obligated to provide you our services and/or to unblock/unrestrict your Account. To delete your account you must send a detailed email to support@dbdcompnet.com, on why you want to delete your account with us, (this also helps us as "FeedBack"), and state clearly, that you want your account to be deleted. With your account deletion, you understand, acknowledge and agree that we are obligated, by European Union Data Protection Regulations, to delete and erase all your personal data and, that when you want to recreate your account, you must provide all your personal data again.

E. INTERN ACCOUNT ("ORGANIZATION ACCESS")

To receive an intern account ("Organization Access/Partner Access"), you must contact the administration of the organization you want to have access to. However, you must have a registrated team on that organization to request an intern account.

To create/request an intern account you need an email adress (all individual players also need an email adress) and a Discord identification (“Discord ID”). You understand, acknowledge and agree that our partners have access and can use your personal data. Our partners are not authorized to store or collect your personal data, however they are authorized to use it for marketing purpose or communication. You understand, acknowledge and agree that all our partners, including the ones you do not participate in/with have access to your personal data and can use it for the same purposes of communication and marketing.

You understand, acknowledge and agree that the DBDCA, DBDCompNet administration and the organization’s administration can restrict/lock your account at any time for whatever reason. You also understand, acknowledge and agree that we and our partners are not obligated to provide you our services, therefore we are not obligated, neither are you entitled, to have your restriction or blockage removed. To delete your account you must contact your organization’s management and sent an email to auth@dbdcompnet.com and set info@dbdcompacademy.com as Cc. You understand, acknowledge and agree that once your account has been deleted, which happens within 24 hours during business hours, we are obligated to delete and erase all your personal data from the DBDCompNet if you’re not registrated on another partner’s site. For Website purposes you understand, acknowledge and agree that we store your personal data until you’re deleted from all current and future partner’s webpages.

F. VERIFIED & AFFILIATED STATUS

To obtain a verified or affiliated status you must meet our partner and verified and/or affiliated requirements. You understand, acknowledge and agree that only Teams, including their players, organizations with a partnership (“DBDCompNet. Certificate License Partner-Contract”) to the DBDCompNet Services and Content Creators are eligible for verified and affiliated status. For teams, this contract is issued automatically by the organization after registration.

   1. Verified Status

The Verified Status is given to partners and content creators that strictly follow our rules and guidance such as the DBD Comp Agreements (“Core Rulebook”) and the PAGCS Code of Conduct (“Protection Association of General Competitive Security Code of Conduct”). Verified Status means they're complying to all our general regulations to protect teams and players from fraud, harassment and unfair judgement. Verified Partners are visibly marked with a golden verification badge. To obtain this badge and status you understand, acknowledge and agree that you must meet general Verification Requirements:

   1.1 Verification Requirements

To receive an official verified badge on our DBDCompNet you must;

• use the PAGCS Code of Conduct as minimum conduct base,
• agree to all DBD Comp Agreements,
• a.) own a Dead by Daylight competitive organization;
  • that has a minimum of 1.000 members,
    • with an average of 65 players.
  • rules against homophobia, racism or sexism,
  • compliance with the Fair Judgement Agreement,
  • that has hosted a minimum of one ("1") tournament.
• b.) own a YouTube and Twitch channel;
  • that has a minimum of 2.500 subscribers,
    • with an average of 200 likes across all videos,
• comply with our Terms of Service at all times,
• not advertise or use services against Dead by Daylight,
  • account modding,
  • cheating,
  • hacking.

   2. Affiliated Status

The affiliated status is given to partners, content creators, communities and parties that strictly follow our rules and guidance such as the DBD Comp Agreements and the PAGCS Code of Conduct. Affiliated Status means they're complying to all our general regulations to protect teams and players from fraud, harassment and unfair judgement. Verified Partners are visibly marked with a golden verification badge. To obtain this badge and status you understand, acknowledge and agree that you must meet general Verification Requirements:

   2.1 Affiliation Requirements

• apply as minimum our Fair Judgement Agreement,
• a.) own a Dead by Daylight competitive organization;
  • that has a minimum of 600 members,
    • with an average of 40 players.
  • rules against homophobia, racism or sexism,
  • compliance with the Fair Judgement Agreement,
  • that has hosted a minimum of one ("1") tournament.
• b.) own a YouTube and Twitch channel;
  • that has a minimum of 1.250 subscribers,
    • with an average of 110 likes across all videos,
• comply with our Terms of Service at all times,
• not advertise or use services against Dead by Daylight,
  • account modding,
  • cheating,
  • hacking.

G. TERMINATIONS

You may terminate the Terms of Service at any time. Take into your decision-making that your Account is tied to the Agreement. When you terminate your Agreement you automatically terminate your Account with us. You understand, acknowledge and agree that you can terminate at any time and that by terminating you follow the way to fulfil an account deletion. You also understand, acknowledge and agree that you can give your Agreement again, but need to provide all information according to the account creation again.

The DBDCA may terminate your Terms of Service Agreement at any time during your maintaining operation of your DBDCompNet Account. Having your Terms of Service Agreement terminated will result in your Account being temporarily locked, which does not result in your personal data to be removed, but also locked for us for thirty (30) days until then deleted and erased. You understand, acknowledge and agree that the DBDCA can terminate your Terms of Service Agreement at any time by any reason or no reason. You also understand, acknowledge and agree that we can, but are not obligated, to give you your chance to agree again.

H. PAYMENT SERVICES

We do not offer paid services. We are 100% free of charge and do not make sells.

I. REAL MONEY TRADING / BHVR FRAUD

Real money trading for Virtual Goods provided by Behaviour Interactive Inc. (“DeadbyDaylight” and more) is strictly legally and ethically forbidden. You understand, acknowledge and agree that any real money trading regarding BHVR’s (“Behaviour Interactive” and “DeadbyDaylight”) Virtual Goods (e.g. Auric Cells in DeadbyDaylight) is not allowed and punishable by law if needed. We strictly prohibit the active and/or passive advertisement of Virtual Goods selling by third-parties (not Behaviour Interactive Inc.). You understand, acknowledge and agree that we are allowed to forward any personal data regarding you, directly to BHVR when we suspect or identify you as real money trader of their Virtual Goods.

We do not guarantee punishment for you, as it is entirely up to BHVR and their responsible team to handle this situation. You understand, acknowledge and agree however, that we are allowed to issue a termination of your Account and Terms of Service Agreement when breaking this term, being suspected of breaking this term.

Real money trading is and/or could be:

• selling Virtual Goods for cheaper, same and/or more expensive prices,
  • when not authorized by BHVR.
• selling BHVR, DeadbyDaylight or any similar Account,
• the general advertisement of these services,
• advertising a tournament with Virtual Goods as price,
  • when not authorized by BHVR.
• sharing an account that does not belong to both or more,

The attempt alone is considered issued real money trading. You understand, acknowledge and agree that this rule applies to all possible Virtual Goods worldwide and will be considered illegal real money trading if not authorized on paper and/or ePaper (“Email”).

J. EXTERNAL TERMS OF SERVICE, TERMS AND CONDITIONS ETC.

These Terms of Service, as explained in the intro, apply to all Webpages and the Website of the DBDCompNet, which includes our subdomains that are also specified to individual organizations. However, you understand, acknowledge and agree that our partners, the webpage owners (legal owner is always the DBDCA), can create their own, but only additional, terms to their webpage. Our general Terms of Service (these Terms of Service) apply, overrule and are active on every partner site. You understand, acknowledge and agree that disobeying individual webpage sites can get you removed from their sites and, for their site, your Account deleted. Partners may work together in these decisions and issue global sanctions against you. You understand, acknowledge and agree that these global sanctions are effective as a termination issued by us.

You understand, acknowledge and agree that we stand behind our partner’s decisions one-hundred (100) percent and will work as they please. A partner’s decision is final and will not changed by us, unless it is being repealed by our Terms of Service. You understand, acknowledge and agree that our partners may change their Terms of Service (etc.) at any time by complying to our Terms of Service and the acceptance time of thirty (30) days after publishing on PARTNER_ORG.dbdcompnet.com (domain varies depending on the partner).

Terms of Service need to comply with german law and European Union General Data Protection Regulations.

K. REPEALING DECISIONS

Partners are allowed to make their own additional terms when using their webpage, however

• overruling, removing our Terms of Service,
• overruling, removing german law,
• overruling, removing European Union regulations,

are automatically being repealed by this rule. You understand, acknowledge and agree that by accessing a partner’s webpage or creating a webpage, that our Terms of Service, such as law and regulations, are overruling your additional terms.

L. DISCLAIMERS & INDEMNIFICATION

The website of the DBDCompNet is owned under fair use by the Dead by Daylight Competitive Academy Group (Association of Competitive Dead by Daylight). 

USED IN THE NAME, (DeadbyDaylight), IS A RIGHTFULLY OWNED GAME BY Behaviour Interactive AND DOES NOT HAVE AN AFFILIATION WITH US, NEITHER DO WE HAVE AN AFFILIATION WITH Behaviour Interactive. WE DO NOT CLAIM A PARTNER STATUS WITH Behaviour Interactive. WE ARE FULLY INDEPENDENT. LOGO’s USED ON THE WEBSITE BELONG TO THE DBDCA, HOWEVER THE DeadbyDaylight LOGO BELONGS TO Behaviour Interactive. ON THE REQUEST OF Behaviour Interactive WE WILL TAKE DOWN THIS SITE AND ALL WEBPAGES CONNECTED TO IT. IF Behaviour Interactive WISHES FOR US TO TAKE DOWN THIS SIT AND ALL WEBPAGES, WE ARE NOT RESPONSIBLE FOR ANY DAMAGE DONE TO ACCOUNT’s. IF YOU’RE A LEGAL REPRESENTATIVE OR CEO, OWNER AT Behaviour Interactive OR DeadbyDaylight CONTACT US UNDER support@dbdcompnet.com TO REQUEST THE WEBSITE TO BE TAKEN DOWN. WE MAINTAIN A FANBASED WEBSITE AND/OR SERVICE FOR DeadbyDaylight AND WILL WANT TO WORK TOGETHER WITH Behaviour Interactive ON ANY PROBLEMS OR ISSUES THEY SEE WITH THIS SITE.

We are not liable for any damage caused to your Account during our maintenance or updates. You understand, acknowledge and agree that we are not liable, neither are we responsible for data loss or Account loss after updates and maintenance. You understand, acknowledge and agree that when Behaviour Interactive requests us to take down the Website, we are not liable or responsible for the loss of your Account, neither is Behaviour Interactive. You understand, acknowledge and agree that this action is issued under our termination rule and obligates us to delete and erase all your personal data from our servers.

Behaviour Interactive MAY REQUEST OUR ACCOUNT USER’s DATA TO CONTROL, MAINTAIN OR WORK WITH TO SOLVE ISSUES, LEGAL CONFLICTS AND/OR IDENTIFY THE ENEMY (“SOMEONE WHO HARMS Behaviour Interactive”).

You understand, acknowledge and agree that we are allowed to share your personal data and Account information with Behaviour Interactive on request. You also understand, acknowledge and agree that Behaviour Interactive is allowed to work, use and store this information and personal data for as long as your Account with us is active and/or a legal conflict has been resolved. We do not interfere with legal conflict, neither do we get input on those.

M. COPYRIGHT & LICENSE

The DBDCompNet (Dead by Daylight Competitive Network) is owned by the DBD Comp Academy Group Organization ("Association of Competitive Dead by Daylight") including all webpages. The use of the term DBDCompNet is reserved to the DBDCA and all partners, they may claim their individual hosted site as their own and represent it individually on social media. Legally all webpages belong to us.

CREATING AN ACCOUNT GIVES YOU AN ACCOUNT LICENSE. THIS LICENSE STATES THAT YOU OWN THE RIGHT TO USE ALL INTERN AND EXTERN WEBPAGES TO YOUR OWN ADVANTAGE. THIS LICENSE IS PERMANENT UNTIL REMOVED BY TERMINATION, BY US AND/OR YOU, AND IS THEN LOST. BY AGREEING TO OUR Terms of Use Agreement YOU AGREE TO OUR ACCOUNT LICENSE (these Terms of Service) AND ANY CHANGES THAT HAPPEN IN FUTURE, AFTER THIRTY (30) DAYS OF PUBLISHING THESE.

Partners obtain a Webpage over support@dbdcompnet.com with their own individual subdomain on the dbdcompnet.com domain. These sites are individually regulated in terms of use by their representing organization.

ALL PARTNERS OWN ("Copyright") THEIR OWN WEBPAGE WITH THE DBDCOMPNET LICENSE THAT IS INCLUDED IN A PARTNERSHIP. THIS LICENSE PERMITS OUR PARTNERS WITH THE RIGHT TO USE, COLLECT AND CLAIM THEIR WEBSITE (webpage). THIS LICENSE EXPIRES AFTER THE 31.12. OF EACH YEAR AND NEEDS TO BE RENEWED BEFORE THE 01.01. OF THE YEAR AFTER.

You understand, acknowledge and agree that all sites are legally owned by the DBD Comp Academy Group and partly owned by copyright by our partners. All rights to the webpages are reserved us and the site's representative organization.

Dead by Daylight USED IN THE NAME AND AS SHORTCUT ("DBD") IS OWNED BY Behaviour Interactive.

N. ADDITIONAL ACCOUNT AND WEB SERVICES

DBD Comp Academys RISK SYSTEM SCORE OR RISK SCORE SYSTEM IS A REQUIRED PART OF THE DBDCompNet. TO CREATE AN ACCOUNT YOU MUST ALSO AGREE TO THE User Agreement OF THE PAGCS (RSS = Risk System Score / Risk Score System). THE SCORE SYSTEM IS ALSO COPYRIGHTED UNDER THE DBD Comp Academy AND ITS PARTNERS.

You understand, acknowledge and agree that all of the RSS User Agreement apply to you, when creating an Account to internal access.

O. TERMS OF SERVICE

THESE Terms of Service ARE KEPT UP-TO-DATE BY THE DBD Comp Academy ADMINISTRATION.

The Account is tied to the Terms of Service Agreement, if you disagree with it, including at a later time, you will be unable to log-in, create and/or use your account until you agreed again. Your data won't be lost for thirty (30) days.
